Sanity prevails

Well, a bit of sanity prevailed in one aspect of the whole Washington Redskins name imbroglio.  I had feared in this day and age of political correctness, the team would lose on all aspects of their challenges.  Now lets hope the Patent and Trademark Office will come to their senses on the appeal currently in progress.

WND; the gift that keeps on giving

So, I was perusing WND for shits and giggles and came across a couple of stories:

Shelly Bachmann's Ode to nuttiness.  I cannot impart how much contempt and disdain I have for this woman.  She personifies the birther, wingnut mindset.  The bitch didn't do anything worthwhile during her stint in Congress except spout off conspiracy theories and flatout lies. Yet, remarkably as shown in the comments in the linked article, a lot of people still believe she is the savior of Jeebus and Conservative America.  The difference between Bachmann and Pelosi?  Pelosis doesn't believe the shit coming out of her own mouth.  She is a professional politician and lies accordingly.  I believe Shelly believes everything she says, which I find a lot scarier.

And then there was this article about a Mosque in Georgia.  One of the things that pisses me off about a lot of Christians (not all of them, but a lot), is that they don't understand that our First Amendment guarantees of freedom of religion applies to everyone, not just Christians.  To some of these assholes, it seems their belief is "religious freedom for me, but not for thee". The city initially denied the Mosque a permit, but had approved other churches to operate in the same area.  When informed by the city attorney that they were looking at a probable lawsuit, and would most likely lose under RLUIPA, they quickly reversed course, and approved the Mosque's application.  Well, the people of the good {sarcasm} town* went apeshit as well as a lot of other God Fearin' true patriotic muricans.  Read the comments section in the linked article.  Granted, is is WND, which is festering with the illiterate, the dangerous, and the flatout batshit crazy nutters, but it is so funny these assholes post about the Constitution and don't even realize their arguments are anticonstitutional.  I laughed out loud at the delicious irony of one guy who posted this: "Liberals have an amazing capacity to reject reality".  So says someone posting on WND, the epitome of reality rejection.  Jesus wept.




*interestingly, this is the town that has the famous city ordinance requiring firearm ownership.

additionally, I realized this is the same county from the Fuck the Police story from Wednesday...Go Georgia, sooner or later you'll catch up to Oklahoma for redneck jackassery.

I hate the current crop of republican politicians

When I heard Obama's Cuba decision, I was waiting for the knee jerk response from politicians, more especially the republican ones.  Boy, I didn't have to wait long.  Marco Rubio led the way, with Lil' Teddy Cruz following along.  I can understand that people with Cuban heritage might have an extreme dislike for the Cuban government.  But WTF makes Cubans more special than Vietnamese, Chinese, or survivors from any other totalitarian regime that the U.S. recognizes and has diplomatic, if not economic ties with? I don't hear Rubio or Cruz stating we need to cut ties and start an embargo against China or Vietnam.  Fucking hypocritical douche bags.  Even a Democrat, Robert Menendez got a few swipes in at Obama.  Guess what?  He's Cuban as well.  Hey Douche bags, you fucking lost.  Castro won.  Get over it.  The embargo didn't fucking work.  I'm so tired of a small group of people living in the ass end of Florida affecting the the strategic diplomacy of our country.

Then there are the republicans, (Boehner, McCain, and Graham to name a few) who immediately started whining and barking.  I swear, Obama could state murder was bad and these assholes would object and call him a dictator overstepping his bounds with an unlawful and unconstitutional violation of a persons right to kill someone.  That's enough for now, I've worked myself up into a tizzy.  I need to go calm down.

Yes, I picked on Republicans this post.  However, its because they piss me off.  Dems just make me laugh with disdain because of their holier than thou social, economic, and enviromental justice themes.  The current republicans scare me more than the SJWs of the democrats.

The pussification of the United States

So... I came across this article that basically says animated movies for children are bad, and as parents, we should be careful what we let them watch.  The article mentions Bambi, The Lion King, Finding Nemo, and others.  Seriously????? Bambi?? Finding Nemo??   I watched Bambi as a child with no lasting harm... hell, millions have watched these movies with no lasting harm.  What is with these people?  Oh noes, dey killed bambi's mom, Simba's dad, and Nemo's mom...BFD. We can't protect our children from life itself.  Look, when shit happens (and it will), if they don't have some reference to base their life experiences on, then they are going to be shit out of luck.  Life is sometimes hard and unfair.  These movies teach kids from an early age that they can overcome life's obstacles; or as they say in "Galaxy Quest," never give up, never surrender.  If the trend keeps on this path, we will have a nation of pussies, if we don't already.

A woman in Georgia was arrested for yelling "Fuck the Police" and giving the finger to some cops.  Well, those poor little angels in blue just couldn't stand that a citizen treated them with such disrespect, so in a rage of butthurt, they arrested her for disorderly conduct.

Hypocrite Thy Name Is… ModeratarianMan?


I generally do not have a lot of patience or tolerance with drug abusers.  However, I am not a drug warrior.  I do not believe in prohibition.  I would really love to see marijuana be legalized.  Would I smoke it?  Probably not, just because I do not like the way it makes me feel.  I would not even mind all the other controlled substances being legalized, regulated, and taxed.  It would not totally eliminate the black market; that market will always be there.  Do not believe me?, just take a look at Appalachian area with moonshine, or the smuggling and selling of untaxed cigarettes.  Legalization would reduce the black market to a substantial degree but I digress.

I have personally seen drug abusers destroy their lives and the lives of their family, simply because they would not stop abusing drugs.  The destruction came in the way of stealing from their family, physically assaulting their family, and in some instances, the death of a relationship between a husband and a wife, because one of the two would enable their child and the child's drug addiction.  Because I have seen what it has done to some of my own family members (not in my immediate family), I do not have a lot of tolerance for drug abusers.  Now, I do know that there are some individuals who have an addictive personality.  There is something about them, and in a lot of cases it is hereditary, that keeps them on whatever their abuse.  However, I still feel they could stop the drug abuse if they really wanted.  I believe that in most cases, these people do not want to stop their behavior.  By the age of 19, I had sampled almost all the Schedule I and Schedule II substances, more than once for most of them.  I did not have a problem stopping any of them.  I feel everyone should be able to stop using any of these substances, though it may be hard, if they actually wanted to.

The CFP sucks dirty donkey balls!

TCU got screwed, but I'm not surprised; pissed, but not surprised.  It still amazes me that NCAA football still can't get it right.  Just about every other sport is able to have a valid playoff.  For some dumbass reason, college football still cant get it done.  For the longest time, the champion was picked by sports writers, which was the dumbest thing ever.  Then we had the BCS, which was stupid and corrupt.  I had a glimmer of hope when they announced the formation of the CFP.  However, the glimmer was soon dashed when I found out  there would only be four teams, and another committee would select the teams.  SETTLE IT ON THE FUCKING FIELD, not in a hotel conference room.  The selection chairman said Ohio State earned their spot.  I want to punch that weasel motherfucker in the mouth.  Why weren't they number three last week then, you cooze sniffing asshat?

When icons fall, it's troubling.  It sounds like there may be humongous troubling news for a lot of people because Ol' Bill Cosby may be into some trouble.  Nineteen woman have come forward accusing Cosby of drugging them and molesting/raping them.  Of course Ol' Bill is innocent until proven guilty; but you know the old saying "where there is smoke, there is fire"?  Well, Cosby has a goddamn forest fire going on.



Internet shopping kicks ass

I've never been a "Black Friday stand in line for midnight deals" kind of guy.  Dealing with all the dumb asses out there would drive me to homicide. However, I do love Cyber Monday.  It makes shopping easy and without the hassle of interacting with all the dip shits in the world.  I've got most of my shopping done.  Special thanks to Amazon.com who had had just about everything I was looking for.  I bought stuff for the wife, stepson, daughter and others.

The big lie

One of the things that really drives me nuts is when people state that the Civil War was about State's Rights, and not about slavery.  A lot of the time, this statement is in reference to complaints about the Confederate Battle Flag representing slavery and racism.  Well, the Civil War was indeed about State's Rights...THEIR RIGHT TO HAVE SLAVERY!!!!!   The complaints are 100% right, the flag represents slavery.  Proof after the jump.

More Marc Randazza bad asserey

So I have a man crush on Marc Randazza.  He is a bad ass lawyer.  He is most definitely not a fan of Julien Blanc.  Who is Julien Blanc you ask? Google to find out, but basically he makes Tucker Max look like an angel.  Blanc made a video in which he said some really stupid shit.  the shit in question soon went public, and then viral.  It was posted and discussed on 8chan.  Blanc's attorney sent a takedown notice to 8chan's lawyer.  Guess who that lawyer was?  That's right Mr. Badass himself, who sent a reply, informing Blan'c attorney that 8chan would not comply.  Why am I so giddy (yes, I said giddy) about the reply?  Because Marc schools the fuck out of the other lawyer with wit, sarcasm, and outright contempt.  Just take a look at the awesomeness for yourself.  It may take a couple of readings to get the full effect.  My favorite part? "Jesus Hello Kitty Christ on a Rocket-Powered Toboggan, are you FREAKIN' SERIOUS?"  I never ever expected to see that statement in legal correspondance.

National Novel Writing Month starts tomorrow

I may actually attempt it this year.  The problem is that I write for a living, all day, everyday; I read pages and pages of medical records, daily, then draft a legal analysis.  By the time I get home, I am usually burnt out on writing anymore that day. But if I ever want to do any substantial fiction writing, I have to perservere through the fatigue.  A goal of 50,000 words by the end of November is possible.

Well, I'm going to be busy all day and most of the evening, so I don't think I will have time to make a post relevant to any current events*.  So how about a bit of fiction I wrote last year?  This was in response to a prompt on a writing site.  The prompt was given around Halloween.  The word limit was 500.  The prompt was about finding a mysterious journal from someone you knew but who you never expected to have a journal.  It being Halloween, I tried to give an air of mystery and foreboding to the story.

Religious freedom, not religious privilege

Okay, this will be a quick one because the overreacting from certain quarters is causing me to bang my head against my desk out of frustration.  The Idaho wedding chapel case is not an assault against religious freedoms or a violation of the first amendment.  The place in question is a for profit wedding chapel.  Not a church, but a wedding chapel where people pay to be married.  Because of this, they cannot deny a couple because they are gay.  Just like some ignorant racist cannot refuse to serve someone because they are black.  What's that you say? I'm justa godless heathen who don't understand the word of Jaysus [bad grammar and spelling was intentional]?  Well then, read someone else's take on it.  And before you dismiss his view, read a little of his bio, he is not a heathen.

Too many people incorrectly say religious freedom, when what they really mean is religious privilege.  They want their views to trump the beliefs of everyone else.  Contrary to christian opinion, there is not a war against christianity going on.  There is however, a movement to bring christianity to the same level as the other religions, as well it should be.

My review of "The Judge"


The wife and I saw "The Judge" on Saturday for our date night. It was wonderful. As a lawyer, I tend to view all legal-themed movies with a critical eye; this movie seemed to get a lot right. Not to say there were not some errors in procedure and questioning that would not have flown in an actual courtroom, but overall it was semi realistic.

The movie is about Hank Palmer (Robert Downey Jr.), a typical clichéd rich criminal defense attorney living in Chicago who returns home for the first time in many years for the funeral of his mother.  He apparently has not been home in many years due to a contentious and intolerable relationship with his father, Judge Joseph Palmer (Robert Duvall).  The two fight throughout the time leading up to the funeral.  After the funeral, they have a big blowup and Hank (next day.  While on the plane, he receives a call from his brother that the Judge is being charged with killing a man who had a history with the Judge, in an auto accident.  He immediately goes back to the town to represent his father.  Of course, with the contentious dynamic of their relationship, the Judge does not want Hank to represent him and instead, hires a local bumbling attorney C.P. Kennedy (Dax Shepherd).  We soon meet the smarmy prosecutor Dwight Dickham (Billy Bob Thornton), and it becomes quite clear that C.P is not up to the task.  The Judge reluctantly allows Hank to represent him.  During the course of the trial, we learn more about the fractured relationship between Hank and the Judge.  Frank discovers that his father is ill, which quite possibly played a part in the accident.  To keep from giving out any major spoilers, I will leave the plot synopsis at that.  Suffice it to say, the ending was no big shock.

This movie was both funny and sad.  There were several “laugh out loud” moments and several tearjerker scenes as well.  Mrs. Moderatarian Man alternated between laughing and crying.  I highly recommend everyone go see "The Judge". Both Duvall and Downey give outstanding performances.

Been wanting to do this forever

Well, I finally did it, I created a blog.  Now I just have to hope that there are at least a couple of people out there that care about what I have to say.  Let me begin by telling you a few things about the great [sarcasm] ModeratarianMan.  While I do intend to maintain a certain modicum of anonymity with this blog, I will tell you a few things about myself in my view of order of most importance:

1.    I am a father to a beautiful and wonderful 3 year old daughter and a stepfather to a beautiful and wonderful 18 year old stepdaughter (she currently has shoved her head very far up her ass, and has violated the trust of her mother and I; she is on my shit list), and a wonderful 16 year old stepson.

2.    I am husband to a beautiful and wonderful wife who puts up with all my bullshit.

2.5  I sometimes use profanity as exhibited in the previous factum.  If the occasional use of profanity offends you, you might want to stop reading now and never come back to this page again.

3.    I am a Freemason.

4.    I am an attorney with the U.S. Goverment, specifically with the Social Security Administration.  While I am an attorney, this is in no way a blawg.  I will not be commenting with any expertise on the legality of things going on in today's society.  That is not to say I will not be giving my opinion on such things, just take what I say with a grain of salt, unless I happen to comment on Social Security disability issues.  I will not give legal advice to anyone (note to self, add a disclaimer to the blog).

5.    I am a moderate independent when it comes to politics, though there are some politicians and talking heads I despise with a passion.  As far as my economic views, I am again a moderate;  I will support whatever works, just as long as you are able to prove it works.  Socially I lean (somewhere between 45 and 20 degrees) libertarian.  Hence my blog handle, Modera(te liber)tarianMan.

6.    On a daily basis, I generally read multiple newspapers online, read many blawgs, and read multiple news sites.  I try to stay well informed on current events.

7.    I love art and love to paint, though I have not had the time to paint in a long time.  However, I intend to change that soon and start painting again.

8.    I love to write fiction.  But as with painting, time has been a limiting factor and it has been nigh impossible to put pen to paper, or to describe it more modernly, fingers to keys.

9.    I am not particularly religious. If you know anything about the masons, you know I am not an athiest. However, I hold no love for organized religions, and tend to view them and their followers cynically and critically.  I will at times tear into some of these people for their hypocrisy.

It will take me some time to get this blog's appearance and format to my liking, but I will endeavor to get it finished as quick as possible.  As soon as I can, I will post a blogroll of all the sites I frequently read.  A bit of a disclaimer, I don't necessarily agree with all the blogs (in fact some make me bang my head on the keyboard in frustration), but I believe in being well informed.  That requires you to step out of the echo chamber.  If you want a good start on blogs and blawgs to read, here are two that I read daily: http://volokh.com/ and http://www.popehat.com/.  If you start to explore the listed blogs on popehat, you will get a preview of my blogroll.
